TERMS

(Kennel name) ("BREEDER") agrees to
sell the identified dog to the purchaser ("OWNER") and OWNER agrees to pay
the purchase price set forth above by cash, cashier's check or money order to
be paid in full by the time of purchase. As a condition of this purchase,
BREEDER represents the following:

1. The dog is in good health and has had the following shots: (spell out the
types of vaccines and dates) . The fact
that the dog has been immunized does not guarantee immunity. It must have a
series of shots with the final booster given between 4 and 5 months.

2. The dog has been wormed with (specify brand of wormer used and type of
worms on (dates)

3. The dog's sire and dam have passed a CERF examination.

4. The dog's sire and dam can be traced to Poodles and Cocker Spaniels who
have been registered with the American Kennel Club ("AKC").

5. BREEDER will provide a pedigree for the dog going back at least three
generations.

As a condition of the sale, the OWNER agrees as follows:

1. The dog will be given a good and loving home.

2. The dog will be given good veterinary care.

3. The OWNER will make all reasonable attempts to follow the instructions
given for raising the dog.

4. The OWNER will feed the dog a good brand of premium dog food such as
Science Diet, Eukanuba for Small Dogs, or Nutro.

5. If the dog is being shipped, the OWNER agrees to pay for the shipping and
the veterinary certificate necessary for the shipping.

WARRANTY

LIMITED ONE YEAR: (or lifetime)

The dog is sold with a________ (length of warranty) warranty that it is free of genetic life threatening physical and temperamental defects which would interfere with its ability to be a good pet to the new owner or cause great expense. Examples would be problems with heart, lungs, liver, rage syndrome, extreme shyness, etc. The dog is sold as a companion and (is or is not) guaranteed for breeding purposes.

The pup may be returned for a full refund or replacement pup. Or in cases where the owner wants to keep the defective pup, a mutually acceptable adjustment will be made in the purchase price.

LIMITED 7 DAY:

The OWNERS veterinarian should examine the dog within one week. OWNER needs to notify the breeder and return the pup immediately, if practical and in the best interests of the dog. Otherwise, follow directions as to its care.

If the new owners veterinarian and the breeders veterinarian agree that the illness is shown to originate with the breeder, the above guarantee applies and may include payment of the veterinary fees by the breeder. (Parvovirus or Distemper would be examples)

The warranty set forth in this contract is the sole warranty and is given in lieu of any and all other warranties, expressed or implied, including warranties of merchantability and fitness for a particular purpose. The Owner's sole remedy is under the warranty provision of this contract and the BREEDER disclaims and will not be liable for any other damages including consequential damages, property damage, emotional distress, loss of use, business interruption or veterinary fees unless specifically set forth in this warranty provision.

GENERAL:

If for any reason during a pets lifetime, an owner needs to find a new home for a dog that we have sold them, we will assist or take the dog back rather than see it placed in a shelter.

This contract sets forth the entire agreement between the BREEDER and OWNER and any inconsistent oral terms have no effect on this contract.

If there is any dispute or litigation between the BREEDER and OWNER, the prevailing party will be entitled to reasonable attorneys fees and costs.

REGISTRATION:

The formal pedigree and Cockapoo Club of America registration forms will be sent to the purchaser within 1 month. Registering your dog is a good way to show your support for the continuation of the breed, even if you do not intend to breed or show yourself. Registration is best done early.
